Please read this carefully! This is our CONTRACT.

These Terms and Conditions apply to any services purchased from Alpine Adventure Romania, and govern the contractual relationship between you and Alpine Adventure Romania with respect to any such services. Your booking contract is with SC Alpine Adventure Consultants SRL, a Romanian company based in Bucharest, officially registered (Registration Number J40/8858/17.07.2015).

By booking a tour with us you are deemed to have agreed to these Terms and Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis.

Please read these Terms and Conditions carefully as by booking a Tour with Alpine Adventure Romania you acknowledge that you: a) have read and understand these Terms and Conditions, and b) indicate your express acceptance of and agree to be bound by these Terms and Conditions. If you have confirmed a booking of a tour with more than one client, you shall be deemed to have accepted these Terms and Conditions on behalf of all clients included in the booking and participating to the tour, and as such all participants indicate their assent to these Terms and Conditions. The client who confirmed the booking is deemed to be the designated contact person for all other clients included in the booking.

These Terms and Conditions are subject to the laws of Romania and you agree to submit to the exclusive jurisdiction of the courts located in Bucharest, Romania for the resolution of any dispute under these Terms and Conditions or concerning our services.

Alpine Adventure Romania reserves the right to update and/or alter these Terms and Conditions at anytime, and shall post the amended Terms and Conditions on our Website. Any such amendment shall take effect 10 days following their posting to the Website. The Terms and Conditions published at the time of your booking are applicable to your tour. Changes operated to Terms and Conditions after your booking of a tour do not apply to you.

Our prices are calculated per tour and per person. In case of group bookings, these are subject to negotiation and agreement between the two parties.

Our prices are presented in Euro. The parity that we consider at is the one provided by http://www.xe.com/currencyconverter/.

Our prices are subject to change according to our pricing policies but once a tour is booked the price available at the time of booking stays unchanged and will be paid as such.

You are required to pay a non-refundable deposit of 30% out of the total price of the tour for your booking to be confirmed. If your booking is made within 30 days of the departure date then the full amount is payable at the time of booking. If we accept your booking we will issue a confirmation invoice. Based on this, you will pay the deposit. The deposit will be made through Online Bank Transfers based on the payment details we will send to you when confirming the booking by email. Other means of payment can be accepted, but only after an express request from the client.

The balance must be paid after maximum at the beginning of the tour based on the balance invoice send by us to you. The balance will be paid either through Online Bank Transfers or directly to Alpine Adventure Romania at the beginning of the tour. Other means of payment can be accepted, but only after an express request from the client. If we do not receive a Final Payment, we assume it as Cancellation and there will be no refund of the deposit.

Alpine Adventure Romania is not responsible for any charges levied or charged by third parties and/or financial institutions and payable by the Client as a result of credit card or other payment transactions in connection with the purchase of our services and will not refund or return any fees charged by such third parties in connection with payments made by Clients to Alpine Adventure Romania.

A Client may cancel his/her booking by notifying Alpine Adventure Romania. A cancellation will only be effective when we receive written confirmation of the cancellation. In order to cancel your booking, please send us an email. If you do not get a confirmation of your cancellation by email please call us. We are not responsible if your email message did not reach us.

The applicable cancellation fees shall be determined with reference to the date on which the request to cancel is received by Alpine Adventure Romania and are expressed hereinafter as a percentage of the total price paid for the cancelled tour.

If you cancel a tour:

– 60 days or more prior to departure, we will refund the full amount paid by you;

– Between the date of the tour and maximum 60 days, we will retain the 30% deposit;

– While unfolding, we will retain 100% of the total amount paid for the tour.

Alpine Adventure Romania guarantees all scheduled tour departures that have been booked by a Client shall depart as scheduled (subject to reasonably itinerary changes depending on local conditions).

For a cancelled tour by us we will propose to you a similar tour at a later date at your convenience. If you do not want another tour, Alpine Adventure Romania will fully refund you. However, we will not cancel a tour except in extraordinary circumstances (health problems, family issues or country emergency issues).

Alpine Adventure Romania is not liable for any damages, expenses, losses, or claims which are attributable to the fault of you, the unforeseeable or unavoidable act or omission of a third party unconnected with the provision of any services that form any part of the tour, or a force majeure event.

Alpine Adventure Romania shall have no liability for loss, theft of or damage to baggage or your personal effects while participating in a tour. You should not leave personal belongings unattended in any public areas, on board any mode of transportation, or elsewhere, and you are responsible at all times for your own effects and belongings. Alpine Adventure Romania cannot accept responsibility for and in no event shall be liable for loss or damage of valuables or other articles left in or on facilities used by Alpine Adventure Romania such as hotels, guesthouses, vessels, expedition vehicles, or any other mode of transportation.

You shall be liable for any loss, damage or injury you may cause to third parties. If you have personal liability insurance, it may provide coverage for such contingency.

Hiking / Biking / Skiing / Climbing a mountain, no matter the safety measures one takes to prevent accidents, is an outdoor activity which always includes a certain degree of risk. The participant to such activities must be aware of the risks before starting and must therefore assume his/her one responsibility for the consequences of own actions.

Hiking / Biking / Skiing / Climbing a mountain is an activity which requires from the participant:

  • both intense physical effort and will in order to achieve the desired objective;
  • to have and to carry on himself / herself a minimum of individual equipment, adjusted to the type of the tour, and to know how to use it;
  • to master the basic techniques regarding the safe ascent and descent of the mountain depending on the type of tour (hiking, biking, winter mountaineering, climbing, skiing).
  • The participant must understand prior to leaving for the mountain that these factors are essential in achieving the desired objective.

The failure to reach the objective of the tour (which may be either to reach a summit or just to go along a certain route), if this is caused by the factors below, cannot be held by the participant against the guide:

  • the lack of physical fitness of the participant which can be easily assessed during the tour;
  • sickness of the participant due to factors that have nothing to do with the tour itself;
  • the lack of will of the participant to reach the set objectives, while knowing the elements of the tour (duration, required effort, technicality of the route, risks);
  • the lack of the required individual equipment given the fact that the list of the equipment was communicated before the tour by the guide;
  • bad weather, difficult objective conditions along the route which may endanger the participants to the tour (for example high risk of avalanche or of falling stones, extreme cold etc.).

Hiking / Biking / Skiing / Climbing a mountain in many cases is done as part of a group. In these cases, the participant understands that the guides are responsible for the safety of the entire group and they will distribute their support during the tour for all the participants based on priority factors such as the physical and mental status of the participants, the chances of the participants to finish the route, etc.

The participant agrees that the guide, during the tour, will take and use pictures and videos with him/her for marketing the tour for other participants.

The safe ascent and descent of a mountain is the single most important feature of a tour. In case there are sound reasons for the safety of the participants to be put at risk (bad weather, physical exhaustion, strong wind, extreme cold, avalanche prone slopes), it is the responsibility of the guide to decide for postponing the tour or for returning during the route. The participant understands and assumes this possibility and will act according to the instructions of the guide if such situation occurs.

In case one of the members of the party is subject to an accident or gets sick during the tour, the participant understands that the main responsibility of the guide is to care for the immediate safety of the injured /sick person.

The ascent and descent of a mountain is a group activity and it is organized by the guide who is responsible for ensuring the best possible safety conditions for the participants based on the route features and on the weather. The participant understands this and assumes to observe the decisions of the guide as regards the movement on the mountain.

In case one of the participants, by his/her own behavior during the tour, is a cause of discomfort and/or risk for the other members of the group (by committing an illegal act, by not observing the program of the tour or the decisions of the guide) then the guide may immediately decide to exclude this persons from the tour (while taking care of his/her safety on the route as long this person allows it).

When the guide decides for a certain route or for abandoning the route without reaching the set objective due to objective reasons and the participant refuses to observe the decision, the entire responsibility for continuing the route belongs to the participant, the guide no longer being responsible for his/her safety.

The guide is responsible for preparing the detailed program of the tour (route, phases, duration, the daily schedule, the stops, contingencies, etc.), its communication towards the participants and for putting it into practice.

The guide will submit to the participants, no later than 30 days before starting the tour (where this is possible), the list of the individual pieces of equipment needed for the tour.

The guide checks the individual equipment of the participants before leaving the city for the mountain and when the actual tour starts.

The guide is responsible for the safety of all group members. He will equip the route with safety anchors when these are needed for ensuring the safety of the group.

The guide will carry on him/her the needed team equipment.

The guide assesses permanently the conditions of the route (the weather, the terrain, the participants from the point of view of physical fitness and mental point of view) and decides if the participants may or may not continue.

The guide may decide to exclude from the tour a participant if this, by his/her own behavior during the tour, is a cause of discomfort and/or risk for the other members of the group.

The guide offers continuous assistance to the participants for increasing the chances for them reaching the proposed goal and for their own safety.

In case of necessity, the guide organizes rescue missions.

The participant will inform the guide with regard to all own health issues that during the tour might endanger his/her own safety and of the other participants or might reduce his/her chances of reaching the set objective of the tour.

It is to be expected that the participant is in a good physical shape at the beginning of the tour.

The participant will have upon him/her at the beginning of the route all the individual equipment communicated before the tour by the guide.

The participant will self-evaluate himself/herself continuously during the tour with regard to his/her physical and mental capacity to continue and will communicate immediately with the guide if the case is for a return or for certain health problems.

The participant will observe the program of the tour as communicated by the guide and will observe his/her decisions during the tour.

The participant is responsible of his/her own things (equipment, money, papers, etc.) and their losing or deterioration cannot be held against the guide.

You acknowledge by booking a tour with Alpine Adventure Romania that the nature of adventure travel requires considerable flexibility and acknowledge that you will permit reasonable alterations to the tour by Alpine Adventure Romania. You acknowledge your understanding that the route, schedules, itineraries, amenities and mode of transport may be subject to change without prior notice due to circumstances or events, which may include sickness or mechanical breakdown, incidents in the location where the tour will be operated, flight cancellations, strikes, events emanating from political disputes, entry or border difficulties, extreme weather and other unpredictable or unforeseeable circumstances which are beyond the reasonable control of Alpine Adventure Romania and that Alpine Adventure Romania is not liable to you for such changes or amendments.

Alpine Adventure Romania does not supply travel insurance and/or rescue and repatriation insurance and does not require that you have it. However, we strongly recommend purchasing the appropriate level of insurance to protect against unforeseen circumstances. It is your responsibility to investigate the insurance company and direct all questions about travel insurance coverage directly to them.

You agree that while participating in any Alpine Adventure Romania tour, images, photos or videos may be taken by our guides that may contain or feature you in part or in whole. You acknowledges that they consent to any such pictures being taken and agree that Client hereby grants a perpetual, royalty-free, worldwide, irrevocable license to Alpine Adventure Romania to reproduce for any purpose whatsoever (including marketing and promotions), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation to you or compensation payable to you.
